1. Acceptance of Terms

These Terms of Use (“Terms”) form a legally binding agreement between you and Vyona (“Vyona,” “we,” “us,” or “our”) governing your access to and use of the Vyona platform, including mobile applications, websites, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. You agree that electronic acceptance constitutes a legally binding agreement.

2. EXTREMELY IMPORTANT — REAL-WORLD INTERACTION WARNING

Vyona facilitates spontaneous, in-person social connections between individuals. Vyona does NOT: conduct criminal background checks, verify user identities, screen users, investigate users, supervise meetings, provide security, control user behavior. ASSUMPTION OF RISK - You knowingly and voluntarily assume ALL risks associated with: meeting strangers, physical travel, alcohol consumption, private locations, public gatherings, user misconduct. These risks include, without limitation: assault, harassment, stalking, theft, fraud, injury, illness, death. You agree that you are solely responsible for your decisions and personal safety. RELEASE - To the fullest extent permitted by law, you permanently release Vyona from any claims arising out of interactions with other users.

3. Eligibility

You must be at least 18 years old. By using Vyona, you represent and warrant that: you meet this requirement, you are legally competent, you are not barred from using the Service. Vyona may terminate accounts at its discretion.

4. Safety Is Your Responsibility

Vyona does not provide safety guarantees. You agree to: use good judgment, meet in public places when appropriate, inform others of your whereabouts, protect your property. Vyona is not responsible for user conduct — online or offline.

5. Nature of the Platform

Vyona is a neutral technology platform. We are not responsible for: user behavior, user statements, user content, meeting outcomes, compatibility. Users act independently — not as agents of Vyona.

6. Account Security

You are responsible for all activity under your account. Vyona is not liable for damages caused by unauthorized access resulting from your failure to safeguard credentials.

7. Prohibited Conduct

You agree not to: violate laws, harm others, impersonate individuals, provide false information, exploit the platform, use bots or scraping tools, distribute malware, commit fraud. Vyona may investigate and remove accounts at its sole discretion without notice.

8. User Content

You grant Vyona a worldwide, transferable, royalty-free license to use your content for platform operation and improvement. Vyona is not responsible for user content and has no obligation to monitor it.

9. Privacy and Data Use

Your use of Vyona is governed by our Privacy Policy. You acknowledge that: no system is perfectly secure, other users may access shared information. Vyona cannot control third-party behavior. Vyona reserves the right to verify identity before honoring privacy requests.

10. Identity Verification

Vyona may require identity authentication for: privacy requests, account recovery, suspicious activity, legal compliance. We may deny requests that cannot be reasonably verified. Vyona is not liable for damages caused by fraudulent requests.

11. Third-Party Services

Third-party tools may support the Service. Vyona is not responsible for third-party services or their policies. Use them at your own risk.

12. Service Availability

The Service is provided “AS IS” and may be modified or discontinued at any time. Vyona is not liable for outages, errors, or data loss.

13. DISCLAIMERS

To the fullest extent permitted by law, Vyona disclaims all warranties, including: merchantability, fitness for a particular purpose, safety, reliability, availability. We do not guarantee: user authenticity, behavior, compatibility, meeting results.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Vyona shall NOT be liable for: indirect damages, lost profits, reputational harm, emotional distress, personal injury, death. Liability Cap - If liability cannot legally be excluded: Vyona’s total liability shall not exceed the greater of: $100 USD, amounts paid by you in the previous 12 months.

15. Indemnification

You agree to fully defend, indemnify, and hold harmless Vyona from any claims arising out of: your use of the Service, interactions with users, violations of law, negligence, misconduct. This survives termination.

16. Mass Arbitration Protection

You agree that claims must be brought individually. If multiple similar claims are filed, they shall be resolved in coordinated proceedings at Vyona’s discretion.

17. Binding Arbitration + Class Action Waiver

All disputes shall be resolved via binding individual arbitration. You waive the right to: jury trials, class actions, representative lawsuits.

18. Release of Unknown Claims

You waive protections under laws similar to California Civil Code §1542.

19. Termination

Vyona may suspend or terminate access at any time without liability.

20. Changes to Terms

Continued use after updates constitutes acceptance.

21. Entire Agreement

These Terms and the Privacy Policy form the entire agreement.
